You are a paralegal in a law firm and your firm is acting for Mr. Thomas Lee in his purchase of a condominium unit at 133 Tanjong Katong Road #05-01 Sunshine Meadows Singapore 575246. He has some questions about the purchase of his condominium unit. Your boss has asked you to draft replies to the questions.

  1. After the exercise of the Option to Purchase, you informed Mr. Thomas Lee that you had registered a caveat on his behalf. Explain to Mr. Lee the purpose and advantages of registering a caveat on the property. (6 marks)
  2. Other than a purchaser, name 2 other scenarios where a party has an interest which may be caveated? (4 marks)

.3. Mr. Thomas Lee has applied for a bank loan to finance the purchase of his condominium unit. He thinks that once he signs the Mortgage in favour of the bank, the bank will own the condominium unit. Explain why Mr. Lee is wrong in his thinking and inform Mr. Lee of his rights and obligations as a mortgagor regarding the property. (6 marks)

  1. Mr. Thomas Lee is concerned as his employer’s business is not doing well. He wants to know what rights the mortgagee would have against him if:

(a) he is late in paying one monthly instalment by 2 days; and (2 marks)

(b) he is retrenched and has not paid his monthly instalments to the mortgagee for the past 4 months. (10 marks)

(c) Would the mortgagee be required to obtain an order of court before they exercise their rights? (2 marks)

  1. Madam Rose Ong, is the owner of an apartment unit at No. 66 Rambutan Road #10-01 Singapore (“the property”). The property has been in her family for many generations and she has every intention for it to stay in her family. Madam Ong took a holiday to Beijing and she met Liu Ye, a very friendly tour guide. When Liu Ye told Madam Ong that his dream is to visit Singapore, Madam Ong invited him to return to Singapore with her.

Liu Ye was very impressed by how large Madam Ong’s property and was even more impressed when he found out that the property is unencumbered. Liu Ye became very attentive to Madam Ong’s needs and began to earn her confidence. He prepared an Instrument of Transfer and informed Madam Ong that the Transfer is a document that she has to sign as a surety for his extended stay in Singapore. Being of poor sight, Madam Ong took his word and signed the Transfer.

Liu Ye then quickly registered the Transfer and the property was transferred to his name. Two months later, he sold the property to Mr. Alvin Chin.

One day, Madam Ong was looking through her safe deposit box and realized that the title deed to her property was missing. She lodged a police report and when the police questioned Liu Ye, he confessed to his crime.

Madam Ong is furious when she learnt of the sale to Alvin Chin. She wants to claim the property back from Alvin, arguing that she is not aware of what she was signing when she signed the Transfer.

Advise Alvin whether he has a good title and whether Madam Ong can claim the apartment from him. In answering this question, you must address the following issues:

(a) What is the effect of Alvin registering the Transfer in his favour?(6 marks)

(b) Where does Alvin derive his title from and does it matter that Liu Ye had obtained the apartment by defrauding Madam Ong? Why?(7 marks)

(c) In conclusion, does Alvin have a good title? (2 marks)

(d) If Madam Ong is to sue for the return of the property, will she succeed? Give reasons for your answer.(5 marks)

Purpose and advantages of registering a caveat

The main purpose of registering a caveat is to protect the interest of purchasers of a property by way of preventing others from registering interest over the property. The main advantage of registering a caveat in the given case scenario is it alerts third parties about the interest of Mr Lee and it is also helpful in preventing fraudulent dealings.

Other parties who may caveat

The other parties that can caveat include the beneficiary under the trust and the mortgagee of the property.

Misconception about mortgage

The major misconception about a mortgage is that the ownership transfer from signing a mortgage, but actually it does not, and rather it creates a security interest. With respect to the rights of mortgagor, there is a misconception that the rights of ownership are retained with the mortgagor and they can use the property.

Mortgagee rights

With respect to the rights of mortgagee, there is no legal action or bank charges in the form of late fees on late payment by 2 days. With respect to the default of 4 months payment, banks can ask for full repayment and also initiate a sale of property under mortgage term. With respect to the court order requirement, it is needed only if dispute arises.

Fraudulent transfer – Madam Ong

The transfer as registered by Alvin put suggests the legal title under Singapore’s Torrens System. With respect to the source of Alvin’s title, the title was received from Liu Ye, and the registration protects the Bonafide purchases. This implies that the fraudulent activities by the previous owner does not invalidate the title. With respect to Alvin, he is the registered owner under good faith. It will be difficult for Madam Ong to claim the title as it cannot be easily reversed against Alvin.
