As a jury consultant in a criminal case, it is important to know the types of questions that are posed to potential jurors. These questions come in both a general variety as well as tailored for a specific case. The purpose of the questionnaire is to determine whether a potential juror has the capacity to remain impartial and make fair decisions. Potential jurors must swear that the information they provide is truthful. In federal juror questionnaires, the potential juror is advised of the charges against the defendant and given an estimate of the length of the trial.
Juror questionnaires must remain confidential and often are administered in the trial court setting in order for potential jurors to hear the charges and the nature of the case and to ensure that potential jurors understand the need for truthfulness. All information provided by potential jurors is given under penalty of perjury. Juror questionnaires vary between civil and criminal courts. Ultimately, a jury consultant can have significant influence in which jurors will ultimately be chosen or rejected for the trial.
In this Assignment, you will draft a juror questionnaire based on the charges in a given case study. Your questionnaire should have both general and specific questions and should have as many questions as are necessary to select a jury.
To prepare for this Assignment:
• Read through the examples of juror questionnaires in the Learning Resources and other juror questionnaires that can be found by conducting an Internet search.
• Review the three cases provided in the “Week 4 Cases” document in this week’s Learning Resources, and select one case to use for this Assignment.
• Select a role of prosecution or defense.
By Day 7
Identify which case you selected. Draft a juror questionnaire based on the case from the prosecution perspective or a juror questionnaire based on the case from the defense perspective. (The number of questions is not important. What is important is that you get to the information needed to get the result needed.)
